    1. Acceptance of Terms

    By accessing, booking, or using services from Dr. Jesse’s Auto Repair (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Use and Service Agreement (“Agreement”). If you do not agree, do not use our services.

    2. Services Provided

    Dr. Jesse’s Auto Repair provides mobile automotive maintenance, diagnostic, and repair services. All services are performed at the customer’s requested location.

    We reserve the right to refuse or discontinue service at our sole discretion for safety, accessibility, or operational concerns.

    3. Customer Responsibilities

    By booking a service, you agree to:

    • Provide accurate vehicle information (make, model, year, mileage, condition)

    • Ensure the vehicle is accessible and in a safe working environment

    • Disclose any known issues or prior repairs

    • Secure pets and maintain a safe workspace for the technician

    Failure to meet these requirements may result in cancellation or additional charges.

    4. No Guarantee of Outcomes

    While we strive to provide accurate diagnostics and quality repairs:

    • We do not guarantee that any repair will fully resolve all vehicle issues

    • Vehicles may have hidden, pre-existing, or unrelated problems

    • Additional repairs may be required after initial service

    5. Limitation of Liability

    To the maximum extent permitted by Texas law:

    • Dr. Jesse’s Auto Repair shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

      • Loss of vehicle use

      • Loss of income or business

      • Towing, rental, or transportation costs

      • Additional mechanical failures

    • Our total liability for any claim shall not exceed the amount paid for the specific service provided.

    • We are not responsible for:

      • Pre-existing damage or mechanical issues

      • Manufacturer defects

      • Failures of parts not installed by us

      • Damage caused by customer misuse or neglect after service

    6. Parts & Warranty Disclaimer

    • Parts used may be OEM, aftermarket, or customer-supplied unless otherwise specified.

    • We do not manufacture parts and therefore do not provide warranties beyond those offered by the manufacturer.

    • Labor warranties, if provided, are limited and subject to inspection and approval.

    7. Mobile Service Risks

    By using mobile services, you acknowledge:

    • Repairs are performed outside of a controlled shop environment

    • Environmental factors (weather, terrain, lighting) may impact service

    • Certain repairs may be declined due to safety concerns

    8. Scheduling, Cancellations & Access

    • Appointments are subject to availability

    • Same/next-day service is not guaranteed unless explicitly stated

    • Cancellations or rescheduling may require advance notice

    • Missed appointments or inaccessible vehicles may incur fees

    9. Payment Terms

    • Payment is due at the time of service unless otherwise agreed

    • We reserve the right to refuse service for non-payment

    • Deposits or prepayment may be required for certain services

    10. Membership Plans (If Applicable)

    Membership benefits:

    • Are subject to “fair use” limitations

    • Are non-transferable

    • Do not guarantee unlimited repairs

    • May be modified or discontinued at any time

    Unused benefits do not carry over unless explicitly stated.

    11. Indemnification

    You agree to indemnify and hold harmless Dr. Jesse’s Auto Repair from any claims, damages, liabilities, or expenses arising from:

    • Your misuse of services

    • Inaccurate information provided

    • Unsafe service conditions

    • Unauthorized modifications to your vehicle after service

    12. No Professional or Manufacturer Affiliation

    Dr. Jesse’s Auto Repair is an independent service provider and is not affiliated with any vehicle manufacturer or dealership unless explicitly stated.

    13. Governing Law

    This Agreement shall be governed by the laws of the State of Texas. Any disputes shall be resolved in the appropriate courts located within Texas.

    14. Modifications to Terms

    We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our services constitutes acceptance of any changes.

    Dr. Jesse’s Auto Repair

    17. Membership Overview

    The Dr. Jesse’s Auto Repair Membership (“Membership”) is a subscription-based service that provides eligible members with specified benefits, including but not limited to:

    • Unlimited oil changes (subject to fair use)

    • Included diagnostics

    • Up to four (4) labor hours per month, capped at twelve (12) labor hours per calendar year

    • Priority scheduling (same or next-day service when available)

    Membership benefits are subject to the limitations and conditions outlined below.

    18. Fair Use Policy

    “Unlimited” services are subject to reasonable and fair use.

    We reserve the right to limit, suspend, or terminate Membership benefits if usage is deemed excessive, abusive, or inconsistent with normal vehicle maintenance needs, including but not limited to:

    • Excessive service frequency beyond manufacturer recommendations

    • Multiple vehicles being serviced under a single Membership

    • Commercial or fleet vehicle usage without prior approval

    All determinations of fair use are made at the sole discretion of Dr. Jesse’s Auto Repair.

    19. Labor Hour Limitations

    • Labor hours are limited to four (4) hours per month, not to exceed twelve (12) hours per calendar year

    • Unused labor hours do not roll over unless otherwise stated in writing

    • Labor time exceeding Membership limits will be billed at standard rates

    • Certain repairs may require more time than covered and may be quoted separately

    20. Excluded Services

    Membership does not cover:

    • Parts, fluids, or materials unless explicitly stated

    • Major repairs, engine or transmission replacements

    • Specialty diagnostics requiring dealership-level equipment

    • Repairs deemed unsafe or unsuitable for mobile service

    • Pre-existing conditions identified prior to Membership enrollment

    21. Vehicle Eligibility

    • Membership applies to one (1) registered vehicle only

    • Vehicle must be registered at the time of enrollment

    • Changes to the registered vehicle require approval

    • Additional vehicles require separate memberships

    22. Scheduling & Availability

    • Priority scheduling is subject to technician availability

    • Same-day or next-day service is not guaranteed

    • Emergency or after-hours service may incur additional fees

    23. No Guarantee of Savings or Results

    Membership is intended to provide convenience and value but does not guarantee:

    • Cost savings compared to non-members

    • Prevention of breakdowns or mechanical failure

    • Immediate service availability

    24. Payment & Billing

    • Membership fees are billed on a recurring basis (monthly or as agreed)

    • Failure to process payment may result in suspension or cancellation

    • Fees are non-refundable, including partial billing periods

    25. Cancellation & Termination

    We reserve the right to suspend or terminate Membership at any time for:

    • Violation of these Terms

    • Abuse of services or fair use policy

    • Unsafe or inappropriate service conditions

    • Non-payment

    Customers may cancel at any time; however:

    • No refunds will be issued for unused time or benefits

    • Benefits terminate immediately upon cancellation

    26. Non-Transferability

    Membership benefits:

    • Are non-transferable

    • Cannot be shared between individuals or vehicles

    • Have no cash value

    27. Service Limitations & Mobile Conditions

    All Membership services are subject to the same limitations outlined in Section 7 (Mobile Service Risks). Certain services may be declined due to:

    • Weather conditions

    • Unsafe work environments

    • Access limitations

    28. Parts & Additional Charges

    • All parts and materials are billed separately unless explicitly included

    • Customer-approved estimates are required before additional work is performed

    • Delays due to parts availability are not the responsibility of Dr. Jesse’s Auto Repair

    29. Liability Limitation for Membership

    To the fullest extent permitted by law:

    • Membership services are provided “as-is” without guarantees

    • We are not liable for any damages arising from delays, denied services, or unmet expectations of Membership benefits

    • Total liability remains limited to the amount paid for Membership fees in the preceding billing period

    30. Modifications to Membership

    We reserve the right to:

    • Modify Membership pricing, benefits, or structure

    • Discontinue Membership plans at any time

    Members will be notified of material changes when required by law. Continued use constitutes acceptance.

    31. Acknowledgment

    By enrolling in a Membership, you acknowledge that:

    • You have read and understand these terms

    • You agree to all limitations, exclusions, and conditions

    • You understand that Membership is a convenience service, not insurance or a guarantee of repairs

    32. Payment Disputes & Chargeback Protection

    32.1 Agreement to Contact Before Dispute

    By purchasing services or Membership from Dr. Jesse’s Auto Repair, you agree to contact us directly at: dr.jessesautorepair@gmail.comto resolve any issue prior to initiating a chargeback or payment dispute with your bank or card issuer.

    Failure to do so constitutes a violation of this Agreement.

    32.2 Authorization of Charges

    By providing payment information, you:

    • Authorize Dr. Jesse’s Auto Repair to charge your selected payment method for all services, memberships, deposits, and approved additional work

    • Acknowledge that charges correspond to services rendered, scheduled, or reserved on your behalf

    • Agree that recurring Membership charges are valid and authorized until canceled

    32.3 No Chargebacks for Rendered or Reserved Services

    You agree not to initiate a chargeback for:

    • Services that have already been completed

    • Time slots that were reserved on your behalf

    • Missed appointments or last-minute cancellations

    • Membership fees already billed

    Claims of dissatisfaction do not constitute fraud or unauthorized transactions.

    32.4 Evidence Submission in Disputes

    In the event of a chargeback or dispute, you agree that Dr. Jesse’s Auto Repair may submit the following as evidence to the payment processor:

    • Signed or accepted Terms of Use and Membership Agreement

    • Service records, invoices, and technician notes

    • Appointment confirmations (including date/time and location)

    • Communication records (text, email, or call logs)

    • GPS or service location verification (if applicable)

    This information may be used to demonstrate that services were authorized and/or rendered.

    32.5 Reversal of Fraudulent Chargebacks

    If a chargeback is initiated and later determined to be validly authorized:

    • You agree to repay the full disputed amount

    • You may be charged a $25–$100 administrative fee to cover processing and dispute costs

    • Future services may be denied until the balance is paid in full

    32.6 Suspension of Services

    Any active chargeback or payment dispute will result in:

    • Immediate suspension of ongoing or future services

    • Termination of Membership benefits (if applicable)

    32.7 Collections & Legal Action

    We reserve the right to pursue unpaid balances resulting from chargebacks through:

    • Collections agencies

    • Small claims court or other legal remedies in the State of Texas

    You agree to be responsible for any reasonable costs associated with collection, including fees and expenses permitted by law.

    32.8 Fraudulent Claims

    Filing a false or fraudulent chargeback may constitute:

    • Breach of contract

    • Fraud under applicable law

    We reserve the right to take appropriate legal action if necessary.

    32.9 Acknowledgment

    By completing a purchase, booking a service, or enrolling in a Membership, you acknowledge and agree to this Chargeback Protection Policy.
